PPP Working Group

Infrastructures are a key component to development and growth. Besides, private participation for infrastructure projects has skyrocketed since 1990.

Although these contractual arrangements appear rather efficient, they raise a certain number of difficulties all along the sequence of the contracts: from gestation, to the birth, and then the life of the contract. (preparation, procurement and award,construction and operation)

A CICA Public-Private Partnership (PPP) Working Group* started its works in June 2009, with the following key concepts:

  • Driving element: the economy of the Project (including a financial model)
  • 3 parties must be equally beneficiaries: public authorities, private operators and users.

CICA PPP WG proposes definitions of PPPs and a typology of contracts, and identifies 3 major possible origins of PPPs failures and the related solutions based on lessons learned as for: the choice of the project, the kind of procurement, the way the contract is managed.

The objective of the CICA PPP WG is to propose a PPP handbook.

In order to avoid overlapping and increase its efficiency, CICA PPP WG brings together Experts representatives of a number of PPP Working Groups (such as EIC/FIEC, International Bar Association, etc) in addition to its own Experts.

The CICA PPP WG is composed, up to now, of the following Experts:

  • Enrique FUENTES (Spain), Market Analysis and Development Director, FERROVIAL, Chairman of the European International Contractors (EIC) PPP Working Group

  • Marc FRILET (France), Avocat – Chair of the PPP Task Force of the International Bar Association and Chair of the PPP Task Force of the French Institute of International Legal Experts (IFEJI)
  • Eng. Fernando LAGO (Argentina), Manager of Civil Works of CCI Construcciones SA – Director Strategic Planification Area, Argentine Chamber of Construction and Representative of Inter-American Federation of the Construction Industry (FIIC)

  • MAC Chung Jin (Malaysia), Director Business Development, Muhibbah Engineering (M) Bhd
  • Joe WINGERTER (USA), Major Project Development Manager, Kiewit Corporation

Well Prepared Project Working Group

Many problems encountered by Contractors in the execution of Contracts of Works relate to the overall environment of the Contract, i.e. the conditions governing its preparation and execution.

CICA takes the view that better project quality could be achieved through better project preparation and better definition of all stakeholders' duties and responsibilities.

A CICA “Well Prepared Project” (WPP) Working Group*, chaired by Michel DEMARRE, President of the European International Contractors (EIC), addresses the problems raised.

Its Main objectives are the following:

  • Good tender documents to minimize causes for claims, corruption &/or poor quality
  • Avoid tight and/or unrealistic budgets
  • Definition of clear responsibilities (client, supervising consultant, donor, contractor)

The CICA “Well Prepared Project” (WPP) Working Group is integrated by Experts from Contractors, Consultant Engineers, Employers and Development Banks. Its goal, at least, is to edit a practical check list of issues and related recommendations in order to minimized the problems during Contracts’ life.

Legal Working Group

Among others, last tasks of the CICA Legal Working Group* have included the participation of the revision process of the Multilateral Development Banks’ Guidelines and Standard Bidding Documents for Procurement of Works.

The next task of CICA Legal Working Group is to work on important issues, such as the revision of the UNCITRAL Model Law on Procurement of Goods, Constructions and Services, as well as the revision of the WTO Agreement on Procurement Agreement (GPA).

The CICA Legal Working Group is composed, up to now, of the following Experts:

-       Ms. Francine GURRAL, International Legal Counsel, SADE

-       Mr. Roger FISZELSON,

-       Mr. Marc FRILET, Construction Lawyer - IFEJI Secretary General - Member of the International Bar Association

Sustainable Business Working Group

It was agreed by the CICA Board to launch a CICA Working Group on Sustainable Business* with the aim of exchanging information.

At first instance, CICA Working Group on Sustainable Business represents a forum for representatives from the Construction Industry to discuss issues related to Climate Change, Environment and Sustainable Construction in order to share information, promote green business, develop their knowledge of best practices from around the world and contribute to set up the new regulations which will be issued by the International Institutions. Therefore, the works performed by this Working Group will lead CICA to set up Positions Papers and Proposals.

CICA Regional Federations are designating Experts to participate to the works of the CICA Sustainable Business Working Group that will start in Fall 2010.
